Anshe Chung Studios cracks down on griefing photos
  ... an indulgence in truly asinine, arrogant bullshit.

As "Anshe Chung", the Graefs are an SL celebrity aka "public personality", and the photos and video were taken at a PUBLIC INTERVIEW with CNET NEWS. No one chased AC to get the photos -- by appearing to be interviewed, he/she/it/they made the "artwork and textures of the Anshe Chung avatar" public by doing so in a media-oriented setting. Furthermore, they may have IP rights to the "Anshe Chung" persona, but the avatar was created using SL's servers (and presented in the media event using other people's work product: skin, shape, hair, eyes, clothing, jewelry, and the textures for all those items). The avatar AC and his/her/its/their activities take place using LL-owned servers, and NEITHER THE AVATAR "ANSHE CHUNG" NOR HIS/HER/ITS/THEIR BUSINESS ACTIVITIES EXIST OUTSIDE THOSE SERVERS. The only use for an SL avatar is INSIDE SL; the presumption is that the avatar will be used in-world to make contact with other subscribers. Ergo, any subscriber who appears in the public areas of SL in any avatar form has no presumption of control over screenshots of their avatar (since there is, to my knowledge, no effective contract law in SL, and RL contract law regarding use of one's name and image may not apply to what is basically a cartoon image created solely for use in a computer-networked environment which is WHOLLY OWNED by the company running that environment), and no control over such things as chat logs, logged IM conversations, machinima videos created in-world, etc. When the avatar/subscriber is appearing on a publicized media "event" in which they agreed to participate, there is no presumption of privacy, no possible presumption of control, apart from the agreement to appear for the event.

In fact, by whining about their claim of copyright in this instance, the rich bitch and her bullyboy hubby both qualify as wienies in their own right -- so the entire incident could be described as one whiny wienie being overblessed by an onslaught of multiple wienies produced by other wienies (the latter being the childishly vindictive griefer/s).

The Graefs are only whining because the griefers ruined their pretty PR stunt, and this is their way of pulling the classic 10-yr-old tactic: (whine) "Well, you're not playing by MY RULES, so I'm taking my bat, my baseball, and my glove HOME. So there! (huff... pout... flounce offstage)

I'm surprised PROFESSIONAL JOURNALISTS, who are well aware of the legal limits of constraint that PUBLIC PERSONALITIES can place on use of their images and accounts of their behavior, are caving in to this childishly bitchy attempt at playing Gestapo.



UPDATE:  Someone posted a comment in response to the SL HERALD article, that AC "has to be careful how the Chinese authorities perceive her... involvement in pornography or 'unfitting environments'"... Considering that it is apparently well-known that AC spent at least some of his/her/its/their early days in SL as an "escort" (ie: virtual whore), and "sex teacher" (per an article on the SL INSIDER site), this excuse is so asinine it's hysterical. ROFLMAO!!!

As for the Chinese authorities being worried about the morality of avatar behavior in SL, that's ridiculous: China has long been one of the major hosting sites/sources of web porn (along with Russia), their businessmen are the largest group ON THE PLANET taking sex tours in SE Asia, and Chinese traditional "medicine" is responsible for the steady disappearance of various species all over Asia and Africa who are slaughtered by professional poachers for body parts, which are marketed as rejuvenators of male virility (the fresh/frozen gallbladder of a black bear, for instance, can be sold for as much as $50k/US). Furthermore, if the Chinese authorities are so fucking stupid that they can't tell the difference between someone as a victim of online harassment and those who were the attackers, the Chinese "authorities" need to look for new jobs, as they can't possibly be bright enough to run that country (silly question -- they're still Communists, right? -- and the stupidity and self-aggrandizing policies of the party bureaucrats are JUST that stupid -- which explains why the Chinese population seems to want to depart the damned country en masse, and are willing to sell their souls, their daughters, and their wives into virtual slavery to anyone willing to smuggle them into Canada/Europe/America). THEREFORE, this excuse just doesn't cut it as an explanation for their arrogant, high-handed bullshit. They're just being snarky, bitchy, arrogant assholes.

"Gestapo" brings up another thought -- the avatar name is Chinese, but the married couple who are the subscribers masquerading as AC, the Graefs, have a GERMAN name. While the "canonical" bio for AC claims the person behind the av was formerly a downtrodden flunky for the party apparatchiks in China, I wonder if this story is real -- it sounds like a PR ploy to get sympathy and distract attention, which was probably very useful when they had just started sucking up FIRST LAND lots and becoming FIC landbarons. I doubt the story, personally. If anyone in SL can actually swear they visited the couple IN CHINA, and provides photos to prove it, I'd be interested in hearing about it. Until then, it's just another PR stunt.
